Terms of Use
1. Scope
These terms of use govern the free use of the mobile app “Anumi Voting” and the related browser version at voting.anumi.de (together “Anumi Voting”), offered by Mike Gebert (see Imprint).
By signing in, you agree to these terms of use.
2. Service description
Anumi Voting lets users participate in events together and vote on voting lists (e.g. Eurovision Song Contest, your own events). Events are created by an administrator and shared via QR code or link. Per event, you choose a display name and submit your vote.
3. Sign-in and account
Use of the service requires sign-in via Google or Apple. We do not store any password; sign-in is handled directly by the respective provider.
By signing in you confirm that you are at least 16 years old. Anumi Voting is not directed at children under 16.
4. Voting rules
- One vote per account per event. Each account may cast one vote per event; changes during an open voting phase remain possible.
- No multi-voting attempts. Creating multiple accounts to manipulate an event result is prohibited. We reserve the right to suspend accounts and remove votes from the results in such cases.
- No automated voting. Voting is only allowed via the official apps or the official browser version. Scripts, bots and reverse engineering of the API are prohibited.
- Appropriate display names. Display names that are offensive, illegal, or that infringe third-party rights may be removed without notice.
5. Account deletion
You can delete your account at any time from within the app (Account → Delete account). On deletion, your personal account data is removed; votes you have cast remain in the system in anonymised form, to preserve the integrity of already completed results.
We reserve the right to suspend or delete accounts of users who materially violate these terms of use.
6. Availability
We aim for reliable availability but cannot guarantee uninterrupted access. Maintenance windows, technical issues, or force majeure may cause downtime. As the service is free of charge, you have no claim to a specific level of availability.
7. Liability
We are liable under the statutory rules, limited as follows:
- For damages arising from injury to life, body or health, we are liable without limitation.
- For intent and gross negligence, we are liable without limitation.
- For slight negligence, we are only liable for breach of material contractual obligations (cardinal obligations) and limited to the foreseeable damages typical for the contract.
- Any further liability is excluded.
8. Intellectual property
The app, the browser version, and all related content (excluding display names entered by users) are protected by copyright. The “Anumi” brand and the word mark “Anumi Voting” are used by the provider; any commercial use requires express consent.
Anumi Voting is not officially affiliated with the EBU (European Broadcasting Union) or the Eurovision Song Contest. Anumi Voting is an independent voting service that can, among other uses, be used for private Eurovision watch parties.
9. Privacy
Our handling of personal data is described in our Privacy Policy.
10. Governing law and jurisdiction
These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another EU member state, mandatory consumer protection rules of your home country remain unaffected.
To the extent permitted by law, the place of jurisdiction for all disputes arising from this user relationship is the provider’s seat (Frankfurt am Main, Germany).
11. Changes to these terms
We may adjust these terms in case of legal changes, changes to app features, or security requirements. Changes will be published in the app and on this page. If you do not agree with the changes, you may delete your account at any time (Section 5).
12. Severability
Should any provision of these terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the applicable statutory rule.
